1. Agreement

These Terms govern your use of www.klimakit.com (the “Site”) and any purchase you make from Klima Design Works (“Klima,” “we,” “us”). By using the Site or placing an order, you agree to these Terms, our Store & Return Policy, and our Privacy Policy. If you do not agree, please do not use the Site.

2. Products and Fitment

We design, make and sell climate control parts and upgrade kits for vintage Mercedes-Benz vehicles. We try to describe products, compatibility and pricing accurately, but errors can happen.

You are responsible for confirming that a product fits your vehicle before ordering. If you are unsure, contact us first.

We are not affiliated with Mercedes-Benz Group AG or Sanden. Their names and model designations are used only to describe compatibility. All trademarks belong to their owners.

3. Orders, Pricing and Payment

  • Placing an order is an offer to buy. A contract forms when we ship the order.
  • Prices are in US dollars. Applicable sales tax and shipping are added at checkout.
  • We may refuse or cancel any order, including orders with pricing or listing errors. If we cancel after you pay, we refund you in full.
  • Payment is processed by our payment provider ([e.g., PayPal / Stripe]). We do not store your full card number.

4. Shipping, Returns and Warranty

Shipping times, returns, refunds and warranty coverage are set out in our [Store & Return Policy]. That policy is part of these Terms.

5. Installation and Use

Our kits modify your vehicle’s original system and are sold for off-road use only. They should be installed by a technician certified to service motor vehicle air conditioning systems. You are responsible for safe installation and for complying with laws that apply to your vehicle and to refrigerant handling.

6. Our Content

The Site’s text, photos, designs, drawings and installation instructions belong to Klima or its licensors and are protected by copyright and trademark law.
If you buy a kit, you may download and print its instructions for installing that kit. Otherwise, you may view the Site for personal, non-commercial use only. You may not copy, republish, sell or mirror our content, or remove copyright notices, without our written permission.

7. Acceptable Use

You agree not to:

  • break the law or infringe anyone’s rights through the Site;
  • interfere with the Site’s operation or security, or try to gain unauthorized access;
  • scrape, copy or reverse-engineer the Site or its software;
  • submit false information or fraudulent orders.

We may suspend access for anyone who breaks these rules.

8. Links to Other Sites

The Site may link to sites we do not control. We are not responsible for their content or practices, and a link is not an endorsement.

9. Disclaimers

The Site and its content are provided “as is.” We do not guarantee that the Site will be error-free, uninterrupted or always current, and we may change it at any time.
The warranties for products you buy are those in our Store & Return Policy, plus any warranties that the law gives you and that cannot be excluded. If you are a consumer in Massachusetts, nothing in these Terms limits your implied warranties of merchantability or fitness for a particular purpose (Mass. Gen. Laws ch. 106, §2-316A).

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental or consequential damages, such as lost profits or loss of use, arising from the Site or our products.
  • Our total liability for any claim is limited to the amount you paid for the product involved.

These limits do not apply to personal injury, or where the law does not allow them.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Massachusetts, unless the law of your home jurisdiction requires otherwise.

12. Changes to These Terms

We may update these Terms. The date at the top shows the latest version. Changes apply from that date and do not affect orders already placed.
